对中国政府拒绝国外艾滋病感染者入境事件的声明

 

据《环球时报》3月11日报道,中国政府于此前拒绝一名携带艾滋病毒的澳洲作家入境。同日,外交部发言人秦刚答记者问时,却以"中国关于包括艾滋病毒携带者在内的传染病患者入境方面有明确的法律规定,都是公开的"作为回应。中国艾滋工作民间组织全国联席会议对此深表遗憾。

 

此种行为有违政府在《艾滋病防治条例》等法规中和政府各级发言人长期强调的反对感染者歧视的立场,而限制感染者入境本质上更是对于感染者的歧视;另一方面,限制感染者入境缺乏公共卫生科学上的支持,通过限制感染者入境并不能达到有效控制艾滋病毒传播的目的。除了深表遗憾之外,我们还认为,中国政府在对待国外艾滋病感染者入境问题上应坦诚相待,并且树立起负责任的文明大国形象,加快立法进程,积极有效地修改相关出入境管理规定。

 

我们注意到,这是2007年以来中国政府官员第三次就艾滋病病毒感染者入境中国问题公开发表意见。

 

早在2007年底,全球基金即将在中国召开理事会之际,我国政府就曾对艾滋病病毒感染者入境问题做出承诺。卫生部新闻发言人毛群安及卫生部副部长黄洁夫分别在公开场合称:"中国正在着手修改现行有关限制艾滋病病毒感染者入境的法规,取消对艾滋病病毒感染者的入境限制"。中国新闻社曾于2007年11月12日报道此消息,网络链接如下:http://www.chinanews.com.cn/jk/zcdt/news/2007/11-12/1075199.shtml。

 

之后的2009年底,国务院防治艾滋病工作委员会办公室副主任、卫生部疾病预防控制局副局长郝阳在清华大学全球健康论坛上称"目前就世博会期间采取临时措施允许艾滋病感染者入境问题,已与公安部门达成共识"。中国少年网于12月28日刊载了该新闻

由此可以看出,中国政府对待艾滋病病毒感染者入境中国的问题,没有坚持一贯的立场,而是采取了双重标准。通过查阅中国的相关法律和申请政府信息公开,中国艾滋工作民间组织全国联席会议确认了这一点。

 

中国政府1986年制订、1994年修订的《中华人民共和国外国人入境出境管理法实施细则》明确规定"患有精神病和麻疯病、艾滋病、性病、开放性肺结核病等传染病的"外国人不准入境。

 

中国政府1987年批准、1988年发布的《艾滋病监测管理的若干规定》将艾滋病病人及艾滋病病毒感染者列为监督对象,并规定不得入境,一旦被发现,可令其立即出境。

 

中国政府1989年制订并生效实施的《中华人民共和国国境卫生检疫法实施细则》规定,"卫生检疫机关应当阻止所发现的患有艾滋病、性病、麻风病、精神病、开放性肺结核病的外国人入境。"

 

以上三部政府部门规章至今有效,并成为中国对待艾滋病感染者入境中国问题的法定依据。联席会议的成员机构、北京益仁平中心负责人陆军曾于2009年底分别向中华人民共和国卫生部、中华人民共和国国家质量监督检验检疫总局递交过政府信息公开申请,询问2007年以后我国相关出入境法规是否已取消了对艾滋病病毒感染者入境的限制。国家质量监督检验检疫总局答复《中华人民共和国国境卫生检疫法实施细则》规定阻止患有艾滋病的外国人入境,并称《国境卫生检疫法》(草案)已递交至国务院,其中有关于艾滋病病毒感染者入境的修改意见。

 

据此,中国艾滋工作民间组织全国联席会议认为,就当前仍然生效的出入境方面的规定而言,艾滋病病毒感染者及病人仍然不能入境中国,但中国政府正在为此努力修订法律,并会在特定时间抛开规定,短暂开放艾滋病感染者入境。

 

即便如此,中国艾滋工作民间组织全国联席会议认为,中国政府至今拒绝艾滋病感染者入境的做法非常不妥,因为这与《世界人权宣言》等国际公约精神相悖,也和中国的《艾滋病防治条例》相悖――这部由国务院2006年制订的高位阶法规确定了不歧视艾滋病的原则:任何单位和个人不得歧视艾滋病病毒感染者、艾滋病病人及其家属。

 

从另一个方面来说,在全球化的背景下,艾滋病防治越来越注重国际合作,这种拒绝他国艾滋感染者入境的做法,显然会对艾滋病防治的国际合作造成消极影响。早在2007年,全球基金在中国召开理事会的时候,就曾有三名理事对于中国拒绝艾滋病人入境表示过抗议。纵观世界上其它各国的做法,之所以限制外国感染者入境,是由于当时各国对于艾滋病病毒流行的误解。美国、韩国等国就曾在今年取消了对于感染者入境的限制。

 

正是由于相关国际条约中的规定,和我国法律对于艾滋病感染者保护和反对歧视的立场,以及相关部门对于国人和国际社会的承诺,并且由于此一事件在国际社会上所造成的广泛影响对于中国形象的损害,我们在此呼吁相关部门尽快修改、废止此项过时的法律条款,真正做到尊重和保护艾滋病感染者,真正做到对于艾滋病感染者的非歧视。同时,也是恪守相关部门对于国人以及国际社会的承诺,维护中国政府以及中国的国际形象。

 

在相关条款尚未废止、修改之前,我们建议在一些重要的外事活动中,对于申请入境的感染者,采取临时性措施允许其入境,避免该限制性条款直接影响到我国各项外事活动,影响到我国的外交关系,损害国家的国际形象。

【China AIDS:5263】 杭州萧山区去年新增病毒感染者和病人30例,25例由不安全性行为引起

    不安全性行为已经成为我区艾滋病传播的主要途径。昨天,记者从区卫生部门了解到,2009年,我区新增艾滋病病毒感染者和病人30例,其中25例为不安全性传播感染。

  同时,我区艾滋病疫情从外来高危人群向本地普通人群扩散明显,并出现了多例配偶间相互感染的情况。

  我区已累计发现106例

  艾滋病是一种目前尚无有效治愈办法、病死率极高的传染病,随着全球艾滋病的迅速传播,萧山艾滋病病毒感染人数近年来也开始上升。

  数据显示,从2000年我区发现首例艾滋病病毒感染者以来,截至目前,我区累计发现艾滋病病毒感染者和病人共106例。目前生活在萧山的艾滋病病毒感染者和病人有70人,其中21人已经发病,发病者均在进行国家免费的抗艾滋病病毒药物治疗。

  不安全性行 为成最主要传播途径

  近年来,我区的艾滋病传播途径已从静脉吸毒共用针具、有偿供血为主,逐步转向以不安全的性行为为主。去年新发现的30例艾滋病病毒感染者和病人中,有25例为不安全性行为传播所致,即未使用安全套与人发生性关系。

  为何会出现这种情况?区疾控中心艾性科工作人员介绍,近年来由于禁毒工作的不断加强和美沙酮维持治疗工作的展开,萧山因吸毒共用针具感染艾滋病的情况逐渐减少。但随着婚外性行为的增多、青少年首次性行为年龄的提前、未婚同居现象的日益突出,以及外来务工人员的急剧增加,我区艾滋病病毒感染途径出现了变化。这部分人群艾滋病防治知识往往十分匮乏,发生性行为时很少或不用安全套。

  同时,我区艾滋病疫情从外来高危人群向本地普通人群 扩散十分明显。去年发现的30例艾滋病病毒感染者和病人中,男女比例为2:1,其中外地来萧打工人群中发现21例,本地户籍8例,1例户籍地不详。此外还出现了多例配偶间相互感染的情况。

  大多数感染者未被发现

  目前我区累计发现艾滋病病毒感染者和病人共106例。但事实上,确切的感染人数远不止这些,大多数感染者未被发现。

  区疾控中心艾性科工作人员介绍,早期感染艾滋病病毒的人并没有明显的症状,一般潜伏期在7-10年,但有传染性。目前早期发现感染者的惟一方法是通过专业检测。

  区疾控中心呼吁,曾经有过不安全性行为的人,希望能尽早到相关医疗卫生机构进行艾滋病病毒抗体检测。目前,我区所有区级医院以及萧山经济技术开发区医院均可检测艾滋病病毒抗体。区疾控 中心也设有艾滋病自愿咨询检测中心,可以为群众免费提供艾滋病防治咨询和艾滋病病毒抗体检测,咨询和检测的相关个人信息将会严格保密。

    1995年12月4日,读小学的儿子郑亚旗放学回家后对我说:"郑渊洁,老师让明天交18元钱。"
    我说:"知道了。一会儿给你放在书包里。"
    吃晚饭时,我无意问了郑亚旗一句:"交钱买什么?"
    郑亚旗说:"打针。"
    我警觉地问:"打什么针?"
    他说:"预防针。"
    我感到蹊跷。在我们国家,给孩子打预防针都是免费的,学校为什么收费给学生打预防针呢?熟知通过老师向学生推销商品内幕的我打了一个激灵,莫非药品或卫生防疫部门也知耻而后勇地打起了学生的主意?我有一个原则,不管老师让我掏钱买什么没用的东西,我都酣畅淋漓地解囊。但是如果校方动通过往孩子身上注射药剂或口服药片的念头挣钱,我会殊死反抗。作为一个家长,当学校利用权力往你的亲骨肉身体里输入有可能毁了你的孩子的药物时,如果你不但不抗争保护孩子,反而提供经费,你还是父母吗?!
    我向儿子要白皮书。老师每次收费都会给家长一张名正言顺的用白纸打印的信,我家戏称其为白皮书。儿子中止进餐从书包里将白皮书找给我看。白皮书上说是给学生注射"甲肝疫苗"。儿子从我的脸色上判断我可能会拒绝交费,他说:"我明天必须交钱。不带钱,老师会让我回家拿。"我说:"钱你照交,到打针那天,我给你请病假。这针咱们绝对不能打。谁为了经济目的往我儿子身上注射东西,我就跟谁拼命。"我儿子后来说,他从来没见过我的脸色那么难看过。其实这个道理很简单:生养一个孩子不容易。
    次日,我匿名给北京市教育局打电话,向他们询问最近是否在全市小学给学生注射甲肝疫苗,回答是否定的。保险起见,我又给北京市卫生局打了电话,答复依然是否定的。为了杜绝冤假错案,再保险起见,我又给儿子就读的学校所在的区教育局打了电话,答复还是不知道此事。放下电话,我浑身颤抖,我不能不想起日本731部队。家长将生龙活虎的孩子送到学校,难道孩子一进校门就变成了任人宰割的牲口?
    当天晚上我向儿子宣布,打针那天你不用去上学了。我将调查结果向他通报。往常每逢我不忍心看儿子受应试教育摧残而弄虚作假给他写假条让他获得放风的机会喘口气时,他都比较高兴。而今天他问我:"其他同学怎么办?"
    我没听明白,问:"什么其他同学?"
    郑亚旗说:"既然你知道了我们学校打预防针是为了赚学生钱,针剂可能是伪劣产品,你干吗不救所有的学生?他们也是父母费劲儿养大的呀?"
    我和儿子对视了足足两分钟一句话没说。我清楚我这次如果不制止他的学校给学生打甲肝疫苗,我这辈子甭想在他面前抬头做人了。
    儿子又补充了一句:"如果是通过给全市所有局以上干部打针挣钱,你管不管无所谓。"
    第二天,我以家长身份匿名给区教育局打了举报电话。放下电话,我担心区教育局忙于升学率疏忽我的举报,又给某电视台新闻部我的一位记者朋友打了电话,请他出面直接制止我儿子的学校擅自给学生打针。那朋友马上以电视台的名义给学校打电话,校方一听是电视台自然紧张,答复是打针系地区卫生防疫站通过校医联系实施的。记者朋友又给该卫生防疫站打电话核实,答复是此事纯属本站工作人员个人行为,没有接到文件。
    次日,学校向家长退款。我再三叮嘱儿子,不能走漏是我破坏打针的风声,否则你在学校的处境会朝不保夕。儿子说当然得保密。
    我不得不佩服记者的嗅觉。我以为事情已经完了,没想到几天后记者朋友来电话说,他继续调查了此事,甲肝疫苗一支才10元,学校敢收学生18元!他还说卫生防疫站可能是13元批给学校,学校每支干赚5元!他还说卫生部认可的生产甲肝疫苗的厂家有哪家哪家,其余的都是不合格药品。还说经他了解我儿子学校准备给学生注射的甲肝疫苗的生产厂家名不见经传。他说这样缺德的事如果不曝光后患无穷。我一听急了,说你敢!你爱曝哪所学校都没关系,就是不能曝我儿子的学校。你们新闻部的人都知道是我给你提供的新闻线索,你们去学校拍摄时,你怎么能保证你们的司机不和学校的司机聊天?一骂交通警就有共同语言无话不说了。如果让学校知道了是我搞的鬼给学校造成了这么大的经济损失,我儿子 往后还怎么在学校混?我威胁他说你如果曝光我就和你断交。他权衡后选择了作罢。
    1998年3月18日,山东单县卫生防疫站副站长宋新华自行携带碘钙营养片到单县城关第一完小推销。宋新华是每片9分1厘进的药,他卖给学校每片4角。学校卖给学生每片6角。3月24日至25日,学校将碘钙营养片发给18个班的1242名学生服用,至26日中午,先后有412名学生出现口干、腹痛、恶心、呕吐等不良反应,其中391人到医院接受治疗。
    1998年1月8日,兰州市地方病防治领导小组、市卫生局和市教育局向全市中小学印发了《关于在中小学生中开展强化补碘及碘缺乏病监测的通知》,要求全市中小学生每人交28元至30元的补碘费,然后由学校向学生以每片0.77元的价格出售由市卫生局统一以每片0.10元向贵州兴义制药厂购买的海藻营养碘片。该药未经卫生部批准。截止4月11日,已有6300名学生服药后出现恶心、呕吐、腹痛等不良反应到医院治疗。
    1998年4月,邢台市卫生防疫站学校卫生科的王焕新以每片0.20元的价格卖给清河县教育局8万片陕西汉江制药有限公司生产的"速效肠虫净片"。清河县教育局加价后在4月15、16日两天以每片0.50元出售给全县学生每人两片,约有16000多名学生服用了该药。服药的当天,部分学生开始出现不良反应:高烧、腹泻、呕吐等。仅16日一天,就有4000名学生到医院治疗。清河第一小学学前班的学生也在劫难逃,17日,学前班一位女生在清河第二医院输液时对采访此事的记者说:"老师说了,不吃药也要交钱。我吃了就肚子疼。"
    学校是教书育人的地方。如果学校将学生当作摇钱树,这还是学校吗?如今,我们的孩子事实上已经成为学校向家长勒索钱财的人质,有自己的亲骨肉在"绑匪"手中,哪个家长敢不老老实实交钱?如果我的儿子仍在那所小学上学,给我10个胆我也不敢写这篇随笔!一个老师曾经对我说过这样的话:"如果我对哪个学生或他的家长有意见,我治这个学生的最好办法不是体罚他或骂他,而是永远不搭理他!"我当时毛骨悚然。这在本质上属于撕票。
    1998年4月,吉林省长春市朝阳区检察院破获一起特大贪污案。吉林省教委下属办公室的工作人员孙瑞星贪污公款200多万元。一个普通工作人员在不是创造巨额利润的企业的教委办公室居然能贪污200多万元!孙瑞星和宋新华肯定不认识,但他们两人却像捆绑销售的伪劣产品,在我眼前久久挥之不去。
    家长之所以任凭学校搜刮钱财,说穿了是怕孩子日后上不了大学。为了孩子能上所谓的好学校或在学校受老师的器重以保证孩子将来跨进大学的门,家长面对学校忍气吞声忍辱负重什么都可以付出。但当学校要拿孩子的命挣钱时,家长也能付出吗?
    其实,拥有大学文凭的真正含义是好找工作,而找工作的真正含义是给别人打工。因此,大学文凭实际上是一张加入打工族的特别通行证。没有大学文凭的真实含义是不好找工作,不好找工作的真实含义是逼迫自己创业当老板。因此,没有大学文凭实际上是进入老板序列的特别通行证。1997年美国《福布斯》杂志公布的美国最富有的400人名单中,有一支引人注目的没有大学文凭族,其中有中途退学的世界首富比尔・盖茨;有连初中都没读完就退学的克莱斯勒汽车公司大股东凯尔克・科考里安;有曾被布朗大学开除的现在拥有特纳广播公司的泰德・特纳;有上了一半大学就急不可待地退学的现在拥有世界上最大的废物处理公司的哈里・韦恩・休塞加……
    作为家长,如果您希望自己的孩子将来当老板,他有没有大学文凭实在是无关紧要的事。任何一级工商管理部门在您的孩子创办企业申领营业执照时都不会因为他没有大学文凭而将他拒之门外。如果您希望自己的孩子日后当打工仔,大学文凭对他来说就是举足轻重的事,现在想当一个体面点儿的打工仔倘若没有大学文凭几乎是天方夜谭。
    想明白这一点,希望能看到有决定让孩子将来当老板的家长于孩子在校时就敢对校方的所有不合理行为说不。真有这一天,我们的教育就出现了曙光。
    在1995年12月,我可能救了一个学校的全体学生的命。
    使我内疚的是,我没能同意电视台在1995年底利用媒体警告学校不要通过给学生打针吃药创收。真要是那样,也许今天就不会有如此多的孩子受服用碘片服用肠虫净片伪劣疫苗的荼毒了。上帝宽恕我。
    最后,我给凡是不想白发人送黑发人的家长提个醒儿:当您的孩子告诉您学校要收费给学生打针吃药时,不管您昔日在孩子面前精心塑造了多么道貌岸然正人君子的高大形象,您在交费后也必须屈尊协助孩子作案在打针吃药那天逃学。否则孩子一旦遭遇不幸,巧妇难为无米之炊的您拿什么望子成龙?

MOSCOW – An AIDS outbreak at two children's hospitals in Uzbekistan has killed at least 14 children and left 133 infected with HIV, according to a documentary posted on a respected Central Asian news Web site on Monday.

The editor of Ferghana.ru said the 2007 outbreak was first reported in an official documentary produced by Uzbek prosecutors for government television.

But, he said, the video never aired because authorities had second thoughts about broadcasting it, fearing that it would provoke a public outcry and unfavorable international publicity.

The documentary posted on Ferghana.ru reported that 12 doctors and nurses at two hospitals in the eastern city of Namangan were convicted of treating the children with contaminated medical equipment.

According to the narrator, the health workers were sentenced to prison terms of from five years to eight years and eight months.

Uzbek officials, including prosecutors, did not return repeated phone calls from The Associated Press seeking comment.

The AP could not verify the authenticity of the documentary, which would be the first official confirmation of the long-rumored outbreak, but a former Uzbek television producer said it appeared authentic.

Daniil Kislov, editor of Ferghana.ru, said his site obtained the video from an Uzbek health official after authorities canceled plans to broadcast it.

Government officials keep a tight grip on the media in Uzbekistan, where President Islam Karimov has ruled for more than 20 years.

Several outbreaks of hospital-transmitted HIV have been reported among children in Central Asia in recent years. Doctors in the region have sometimes prescribed transfusions for routine illnesses.

Similar incidents in Kazakhstan in 2006 and Kyrgyzstan in 2007 left dozens of children infected.

The Uzbek documentary shows a series of men and women, identified as health workers, confessing and saying they deserved harsh sentences. All the interviewees spoke into a microphone with the logo of Uzbek state television.

"I am 1,000 times sorry," one of the nurses said through tears. "I would not want a single nurse or doctor to repeat those mistakes."

There are also interviews with the mothers of some of the infected children, as well as with a prosecutor.

Ferghana.ru first reported the HIV outbreak in Namangan in October 2007, but at the time officials denied that it had occurred.

Kislov said the video was produced in January 2009, and was obtained from a Health Ministry official who demanded anonymity because he feared persecution by authorities.

"This is a genuine product of Uzbek television," said Alisher Komolov, who worked for the Yoshlar television channel until he left the country in 2006. "The editing layout, the choice of words and the overall denunciatory tone resemble other propaganda videos, especially the ones on Andijan."

In 2005 government troops killed hundreds of mostly peaceful protester sin the eastern Uzbek city of Andijan, according to eyewitnesses and human rights groups. Authorities said fewer than 200 died and blamed the violence on Islamic militants.

Uzbek television showed several documentaries that supported the official viewpoint and slammed Western non-governmental organizations and reporters for allegedly funding the uprising and providing biased coverage.

The United Nations says Uzbekistan has one of the world's fastest-rising HIV infection rates. About 16,000 cases of HIV/AIDS were reported in 2009 — more than an eleven-fold increase from 1,400 cases in 2001, a World Health Organization report said.

For many in this predominantly Muslim nation of 27 million, HIV and AIDS are taboo subjects. At the same time, infection rates are rising due to a sharp deterioration in medical services, as well as a growth of intravenous drug use and sexually transmitted diseases since the 1991 Soviet collapse.

Kislov said the video could not have been made without government cooperation, calling the documentary's style "typical" of Uzbek state television.

"It glorifies the country's leaders and law enforcement agencies and degrades the hand-picked scapegoats," he said.

In late February, Uzbek activist Maxim Popov, who distributed brochures saying condoms and disposable syringes can help prevent HIV, was convicted of corrupting minors by promoting homosexuality, prostitution and drug use. He was sentenced to seven years in jail.

LONDON - The World Health Organization (WHO) says it doesn't have enough information to know if it is winning the fight against drug-resistant tuberculosis. In a new report on the global status of drug-resistant TB based on data from 2008, the agency says almost half of all people with the disease are in China and India, with both countries reporting about 100,000 new cases each.

High rates of drug-resistant TB strains were also seen in eastern Europe, central Asia, with up to 60 per cent of TB victims in Tajikistan and Uzbekistan developing drug-resistant versions.

About 4 per cent of all TB cases worldwide are thought to be drug resistant. WHO estimates between 390,000 and 510,000 cases of drug-resistant TB in 2008, including about 150,000 people who died.

The report is based on information from 35 countries worldwide, leaving a huge gap in the global TB picture.

"The country data reported to WHO make it impossible at this time to conclude whether the (drug-resistant TB) epidemic worldwide is growing or shrinking," WHO said.

Drug-resistant tuberculosis usually arises when people are poorly treated or take substandard medicines. In Estonia, Latvia and Moldova, WHO said people infected with both HIV and TB were more likely to develop drug-resistant TB.

But there is no information from Africa where the most people with HIV live.

One cause of drug resistance are poorly manufactured medicines, mainly from India and China, said Mr Philip Stevens, a health policy expert at the London think-tank International Policy Network. Mr Stevens said the lack of global TB data was troubling.

"WHO doesn't really have a clue as to the true extent of the problem," he said. "It's difficult then, to start promoting targets and goals when you don't know what baseline you are starting from." AP
