    在全世界,毒品使用者遭受了各种痛苦以及来自政府的歧视。这一周,在泰国曼谷召开的国际减低伤害大会上,毒品使用者及倡导人员将向联合国毒品及犯罪办公室工作人员提出建议,以要求他们尽快地废除和应在公共卫生领域和执法领域在毒品使用问题上极端的冲突。

      我们对要求联合国废止对毒品使用者造成伤害的戒毒治疗的呼吁进行签名

 

我们已经听到,看到,经历过,并有证据可知的大范围的吸毒者的人权侵犯。数据表明了吸毒者在各国中以"戒毒"和"治疗"的名义被拘留时,已经历了不计其数的严打、抓捕、监禁以及其它的侵犯。至今,联合国各机构、双边援助国、特别是联合国毒品与犯罪办公室,在应对解决毒品使用时公共卫生和法律实施之间的极端的矛盾时,采取的行动少之又少。
   
来自于世界各地的众多近期的报告详细的描述了大量的对吸毒者在寻求戒毒治疗时遭受侵犯的案例。大多数国际组织有责任监测毒品的相关政策,其中包括已经认识到人权侵犯问题的联合国的组织。我们这些毒品使用者和倡导者向联合国提出的请求:
1
.所有的联合国机构和双边援助者必须立即敦促政府撤销那些认定吸毒者是有罪的法律,提升以权利和健康为基础的方式应对毒品相关问题;
2
.联合国相关机构和双边援助国需要立即敦促政府将吸毒者纳入一个包括发展、执行、评估以及以证据为基础的吸毒治疗政策和项目之中,其中还应包含综合的以权利为基础的减低伤害的方式。
3
.所有的联合国组织和双边援助国必须立即废止残忍且无人性的有辱人格的戒毒治疗方式,正如其它形式的对吸毒者德人权侵害一样。
4
.所有的联合国机构和双边援助国应当立即敦促政府废除镇压式的对人权造成侵害的毒品政策,并且要求政府采取行动来处理那些个人或者是机构对权利侵害所构成的罪。
5
WHOUNODC合作,必须建立一关于针对世界抗击毒品时的健康状况评估,尤其是语言中受到影响的国家。
6.
所有联合国机构和双边援助国必须将吸毒者纳入他们的机构战规划之中,并且广泛发布这个计划以确保其公开透明和责任度。

联合国,通过毒品及犯罪办公室和其它双边援助者,必须应对在如下领域与当地政府的交流:

执法培训:

·培训各个级别的警察,尤其是街上的巡逻警,关于减低伤害的政策和方法,让他孟具有一定敏感度。

·那些对吸毒者进行骚扰、侵害、严刑拷问以及犯有任何侵害罪的执法人员应该对此负有责任并且应通过法律对其进行审判。

·警察应当提醒和帮助吸毒者参与合适的健康和社会服务(包括住房),以执行减低伤害;而不是逮捕吸毒者或者没收他们的注射工具。

· 法律的执行工作需要合作,整合给毒品使用者提供的社会服务,在所有法律执行的层面和阶段,都确保政策上广泛地理解和尊重。

 

应对污名化

·让全体公众对减低伤害的价值就有敏感度,以减少社会给毒品使用者的污名和歧视。

·让全体公众对毒品使用者的人权和对人道的戒毒治疗有一定的了解。

·执行WHO的关于医务人员对毒品使用者开展工作的各项指导意见。

 

提升监狱、审判前拘留、其它封闭关押场所以及包括戒毒所在内的人员生存环境
·将减低伤害的相关服务引入,包括针具交换和安全套的实施,以确保卫生保健的实施,其中包括在封闭关押场所中的对所有毒品使用者的HIV治疗。

·确保监狱能够提供辅助治疗的药物,包括维持治疗药物和戒毒药物。

·在提供给毒品使用者相关的防治服务的同时,在他们离开监狱或戒毒场所后,也需要提供合适的后续性服务。

·所有的联合国组织和WHO,应当采纳对预防过量使用毒品的相关指导意见和技术性援助。

 

Community Petition from drug users and advocates to the United Nations Office of Drugs and Crime

 

WE, THE BELOW SIGNED, CALL ON THE UNITED NATIONS TO DENOUNCE PRACTICES THAT CONSTITUTE TORTURE IN THE NAME OF DRUG TREATMENT. 

We have heard, seen, experienced and documented widespread human rights abuses of people who use drugs. Accounts illustrate that drug users have experienced beating, chaining, caging, and other abuses while in state custody for drug "rehabilitation" and "treatment". Until now, the actions of the United Nations agencies and bilateral donors, particularly the UN Office on Drugs and Crime, have been woefully inadequate in addressing the deadly conflict between public health and law enforcement approaches to drug use. 
Numerous and recent reports from around the world have detailed widespread abuse of drug users seeking treatment for addiction to drugs. Most international organizations responsible for monitoring drug policy, including UN agencies, have acknowledged these abuses. We, drug users and drug user advocates, present the following demands to the United Nations: 
1. All UN agencies and bilateral donors must immediately encourage governments to repeal laws that criminalize people who use drugs, and to promote a rights- and health-based approach in addressing drug-related problems; 

2. UN agencies and bilateral donors must immediately encourage governments to include people who use drugs in a process of developing, implementing and evaluating evidence-based drug treatment policies and programs that include a comprehensive, rights-based harm reduction approach; 

3. All UN agencies and bilateral donors must immediately denounce cruel, inhuman and degrading treatment of people who use drugs, as well as other human rights violations against them, 

4. All UN agencies and bilateral donors must encourage governments to repeal repressive drug policies that encourage violations of human rights, and demand governments take action against individuals and agencies guilty of rights violations. 

5. WHO in collaboration with UNODC, must commission a health impact assessment of the global war on drugs, or in particularly heavily-affected countries. 

6. All UN agencies and bilateral donors must include people who use drugs in their agency strategic planning process and disseminate this plan to ensure transparency and accountability. 
The UN, through the Office of Drugs and Crime and other bilateral donors, must address the following areas in their communications with local country governments: 

LAW ENFORCEMENT TRAINING 
• Train and sensitize all levels of police, particularly police on the street, on harm reduction principles and approaches; 
• Law enforcement officials who harass, abuse, or use torture against people who use drugs or commit any other violation must be held accountable and brought to justice. 
• Rather than arresting drug users or confiscating their injecting equipment, police should warn and refer drug users to appropriate health and social services, including housing, that implement a harm reduction approach. 
• Law enforcement must work collaboratively, integrating social services that drug users access, across all levels of law enforcement, to ensure that policies are widely understood and respected. 

 COMBAT STIGMA 
• Sensitizing the general public to the value of harm reduction approaches to decrease societal stigma/discrimination against people who use drugs 
• Create awareness among the general public about drug users' human rights and the need for humane drug treatment. 
• Implement WHO guidelines for medical providers working with drug users. 


IMPROVE CONDITIONS IN PRISONS, PRE-TRIAL DETENTION AND OTHER CLOSED SETTINGS INCLUDING DRUG REHABILITATION CENTERS 

• Introduce harm reduction services including syringe exchange programs and condoms and ensure access for healthcare, including HIV treatment, for all drug users in prison settings. 
• Ensure that prisons provide medication assisted treatment, including maintenance therapy and detoxification. 
• Provide proper linkages with prevention and treatment services after drug users are released from prisons. 
• All UN agencies and WHO, should include guidelines and technical assistance for overdose prevention
